Who Dempsey is for
Dempsey is for trainers — independent trainers, small studios, and fitness gyms. Dempsey is a personal client agent that lives in text and helps their clients with check-ins between sessions. Trainers use Dempsey. Clients get those texts after they opt in.
The site and booking
These terms cover the public marketing site at getdempsey.com and the text and SMS messages described below. “Book a 15-min fit call” and “Book a 15-min call” open a scheduling page on Cal.com. Scheduling that conversation does not create an account, a subscription, or a product contract.
Text / SMS messaging
Dempsey check-ins and related coaching messages are text or SMS messages from Dempsey and/or the trainer using Dempsey. They are sent only after a person opts in. A typical way to opt in is to agree when a trainer enrolls them, and to provide a mobile number and consent for those messages.
Consent to receive texts is not a condition of buying something unrelated on this marketing site. This site does not collect phone numbers for SMS.
Message and data rates may apply. How often messages arrive varies with the check-in flow.
Reply STOP anytime to opt out of SMS and text messages. Opt-out is honored, and outbound texts stop. Reply HELP for help. Reply PAUSE to pause messages for about 7 days.
For a trainer’s existing clients, messages do not go out under the trainer’s name unless the trainer approves them.
Dempsey
Dempsey is an AI assistant that helps the trainer. Dempsey is not a human, and is not a substitute for the coach. Messages from Dempsey are not medical, nutrition, or program advice. The trainer stays responsible for coaching and for the program a client follows. Copy on this site is an overview. It is not professional advice.
Acceptable use
Use the site to read about Dempsey and to book a fit call. Do not interfere with the site, attempt to break it, or present yourself as Dempsey, or as a trainer you are not. Do not use the site or the messages to harass anyone, or to text someone who has not opted in.
Intellectual property
The Dempsey name, wordmark, text, and images on this site belong to Dempsey. You may not copy them for another product or brand.
Third-party services
The booking page is operated by Cal.com. Cal.com’s own terms apply once you leave getdempsey.com. The site is hosted on Vercel. Text and SMS messages are carried by messaging providers Dempsey uses to deliver them. Those companies handle that work under their own terms.
No warranties
The site and the messages are provided as is. Dempsey does not warrant that they will be uninterrupted, error-free, or fit for a particular purpose. To the extent US law allows, Dempsey disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the extent US law allows, Dempsey is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of the site or these messages. Dempsey’s total liability for a claim arising out of the site or these messages is limited to the amount you paid Dempsey in the twelve months before the claim, or $100 if you paid nothing. Some places do not allow these limits. Where they do not, the limits apply only as far as the law allows.
Governing law
These terms are governed by the laws of the United States. Dempsey is offered from the United States and is aimed at trainers there.
Changes
Dempsey may update these terms. When we do, we change the effective date below. If you keep using the site after an update, the updated terms apply. You can still reply STOP to opt out of text and SMS messages.
